SUMMARY JUDGMENT GRANTED TO LYNCH SCHWAB & GASPARINI
In February of 2015, Lynch Schwab successfully had a personal injury lawsuit dismissed at the summary judgment stage. The plaintiff was injured during the course of a basketball practice when he stepped on a net located in the out-of-bounds area while chasing a basketball. The settlement demand was $700,000.00. In its motion papers, Lynch Schwab argued that the doctrine of primary assumption of risk applied and that the net itself was an open and obvious condition to the game of basketball.
